1甲方擁有年、月、月的繼承權□, 集體分工□, 購買□, 其他方式□ 于年月日取得該地塊的土地使用權,該地塊的規劃用途為,規劃建筑面積為平方米,土地使用權期限為年月日至年月日,土地使用權證書(或土地使用紅線圖)編號為2。乙方是具有獨立法人資格和資金的個人代表
甲、乙雙方在平等自愿的基礎上簽訂本合作建房合同,第二條合作房屋甲方同意根據現狀提供上述第一條所述地塊的土地使用權,乙方同意按照約定提供建設資金,雙方合作開發并完成本項目建設總建筑面積為平方米的住宅樓第三條住房建設資金經協商,雙方同意甲方提供的上述地塊按當時市場價值人民幣元整(¥:000000.00),作為合作建房資金,乙方應出資人民幣:\\uuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuu。實際建設成本高于或低于預計金額的部分由房屋建設資金承擔和享有,是指自本合同生效之日起至房屋驗收合格、甲方取得房地產證書時所需的全部成本和費用。建設資金不包括甲方為取得土地使用權應支付的土地使用費或通過劃撥方式取得土地使用權應支付的地價。第四條資金的監督和支付住房建設資金應由甲方和乙方共同監督。乙方的資金應在本協議簽訂之日到位協議,存入雙方指定賬戶,由雙方共同管理和支付。所有付款,如材料采購和項目資金支付,只有在雙方簽字后才有效
第五條審批程序和房地產權證的辦理除甲方要求的審批程序外,甲乙雙方應共同負責辦理包括本合同在內的所有審批程序,甲方有義務及時提供辦理審批程序所需的資料;由于當地法規和法律規定,房地產權證只能是土地使用權的所有人,因此房地產權證只能由甲方辦理,但產權歸甲、乙雙方所有。第六條產權共享所有建筑物的產權由甲、乙雙方按以下方式或比例共享:甲方擁有樓層房屋的產權,乙方擁有樓層房屋的產權。甲乙雙方應在天內辦理該房屋的房地產證。辦理產權證后,乙方的部分產權可到公證處辦理產權捐贈或轉讓手續,使乙方的產權合法化第七條設計、建筑工程設計,建筑的招投標和施工監理由甲、乙雙方共同承擔。根據本合同第六條的規定,應將產權分配給甲方的設計圖紙提交審批,并經甲方書面批準后方可實施。根據本合同第6條規定應將產權分配給乙方的設計圖紙須經乙方書面批準后方可提交審批并實施。工程設計招標應在天內于天內在天內進行,整個建設項目應在合同生效后天內開工,竣工驗收應在個月內完成,第8條建筑裝修標準。基礎應按照現行建筑標準開挖至米深。地梁采用混凝土鋼筋砌筑,采用鋼筋。整個房屋應采用框架結構。房屋外預留道路、路面采用混凝土鋪裝,做好路基連接及室外排水工程。外墻裝飾標準:4。室內裝修標準:5。水電安裝及安裝標準:6。樓梯裝修標準:7。門窗裝修標準:第九條雙方的權利和義務。甲方和乙方確認該房地產和土地為一體,雙方分別占該房地產和土地所有權的50%。條件成熟時,將土地使用權登記變更為雙方共有或戶籍
2。自本協議簽訂之日起,甲方保證乙方在土地權屬不變登記期間享有該產權共有人的權利。本條款不得撤銷。自房地產開始建設之日起,雙方應承擔房地產建設用地規劃許可證、建設許可證等相關事宜(包括政府各部門的罰款和公關費用)
4。自本協議簽署之日起,如果該物業被政府征用或發生強制拆遷,雙方應獲得相關補償的50%,包括該物業和土地的拆遷收入(包括拆遷補償費、拆遷安置財產、現金補償)。雙方應響應政府號召,共同遵守法律法規和城市建設規劃,共同維護雙方權益,相互配合
